Was the Democrat congress unwilling or unable (ability) to follow the constitution?
Just to let everyone know I did support reform, but the way it was done was very backwards, specifically some of examples of many:
The passage of this bill far exceeds the powers granted to Congress under the provisions of Article 1, Section 8 of the Constitution which specifically states what Congress can do.
2. The bill grants powers to President Obama and the Executive Branch of government that are not authorized under the Constitution.
3. The new law requires every American, simply by virtue of the fact that they are alive, to purchase health insurance from private companies that will be heavily regulated by the Federal government. This is not authorized under the commerce clause of the Constitution and the Supreme Court has never rendered a decision saying that such power exists.
4. The legislation not only requires people to purchase health insurance, but establishes the terms and conditions that such insurance plans will have. In other words, Americans will be forced to enter into contracts for coverage that they may not want or need.
5. Failure to comply with the requirements to buy health insurance or even health insurance approved by the Federal Government will result in punitive action against American citizens. People will be fined for this failure although the bill calls it a tax. This is an effort to bypass the provisions of the 5th Amendment to the Constitution which provides protection against the taking of our property without “due process”.
6. This tax will be collected by the Internal Revenue Service that will have an additional 16,500 agents and auditors hired to enforce it. This opens the door for people who fail to pay the “tax” being subjected to criminal penalties.
7. In order to facilitate the actions by the IRS the Federal government will have real time access to the formerly private information of Americans including medical records and financial information. This is a violation of our right to privacy and the 4th Amendment protection against illegal searches and seizures.
8. The imposition of this so called “tax” also violates Article 1, Section 9 of the Constitution that limits the type of taxes that Congress can levy.
9. The bill also takes away from the states their historic right to regulate the health care industry, including health care insurance, within their own borders. Everything will now be regulated by the Federal government. This is a clear violation of the 10th Amendment to the Constitution.
10. In addition, the legislation will force State Governments to add millions of people to Medicaid, yet the Federal government will not be funding most of this. In other words, the bill will force the states to impose massive tax increases on their citizens in order to pay for this coverage. Congress has no authority to do this and it is another clear violation of the 10th Amendment.
11. The impact on senior citizens in the United States will be immediate and devastating and will entail a breach of contract between Americans and their own government. We are required to pay taxes for Medicare coverage and have a right to expect that they will have adequate health care coverage when we reach age 65. However, enormous cuts in the funding of Medicare under the provisions of the new law will deny us the coverage we have paid for and inevitably lead to the rationing of health care for senior citizens.
Also should congressional members be required to take a test on their understanding on the constitution as a qualifier for running, and should the congressional districts have specific recourse to pull leaders from office, if congressional leaders blatantly takes action to breach this document as within their defined powers?
Also to let you know I am an Independent and do not particuarly like Repubocrates either.
Bushs Presidency was just as Bad, but I never believed it could actually get worse.
Unwilling. They have little regard for it as some have said outright. I never thought it could get worse than Bush. It did. I am also an indepedent after being a Democrat for 32 years. They moved too far from my core beliefs which are more centrists. There are too few like me who are truly moderate.

Nonoxynol 9 Contraceptives: No Protection against HIV and Other STDs
The Food and Drug Administration wants to be sure that consumers know about new warnings on over-the-counter vaginal contraceptive products that contain the spermicide ingredient nonoxynol 9 (N9). These products include spermicidal gels, foams, films and inserts.
These warnings emphasize that nonoxynol 9 does not protect against infection from HIV, the virus that causes AIDS, or other sexually transmitted diseases. The warnings are intended to correct a mistaken impression that nonoxynol 9 protects against STD infection, including HIV/AIDS. In fact, using it may actually increase the risk of contracting HIV/AIDS from an infected partner, because nonoxynol 9 can irritate the vagina and rectum.
The new labeling makes several other points:
• Nonoxynol 9 contraceptive products are for vaginal use only, not rectal use. If you or your partner experience burning, itching, a rash or irritation of the vagina or penis, stop using it and talk to your doctor.
• You can use nonoxynol 9 for birth control if you are not at risk for getting HIV/AIDS i.e., you have sex with only one partner who is not infected with HIV and who has no other sexual partners or HIV risk factors.
• Don’t use nonoxynol 9 spermicides if you or your partner have HIV/AIDS, or if you don’t know whether you or your partner are infected, or if either of you has multiple sex partners or other HIV risk factors. Instead, use a condom that doesn’t contain nonoxynol 9. Remember, when used correctly every time you have sex, latex condoms can greatly reduce, but don’t eliminate the risk of catching or spreading HIV.
• And finally, talk to your doctor, pharmacist or other health care provider if you have questions about your options for birth control or about how to prevent infection with sexually transmitted diseases.

I ran into the hazards of Cow Parsnip while living and working in Alaska in the 1980s. Wish this video had been around then. Heracleum (the hogweeds) is a genus of about 60 species in the carrot family. They are found throughout the temperate northern hemisphere and in high mountains as far south as Ethiopia. Some species, especially the Giant Hogweed and Cow Parsnip, have saps that contain a phototoxin that can act on contact with skin and exposure to ultraviolet light (a part of sunlight), causing anything from a mild rash to a blistering, severe dermatitis, depending on the sensitivity of the individual. Giant Hogweed has become a serious invasive weed in many areas of Europe and North America and affecting workers whose job is to remove it. How to waive an order of protection in NYS?
Have a criminal court ordered order of protection against my husband…. I am 5 months pregnant with is child and he is in county jail until the 8th of April. There is a serious issue with our unborn daughter and I need solid information on how to waive the OOP so I can go visit him in jail just once to discuss the health issues and choices with him. Any serious information would be greatly appreciated. Thank you.
We are in NYS…. not the city though, just in case different rules apply.
Contact the judge’s bailiff and see if he’ll get you an appointment with the judge to get a waiver for this one visit while your husband is still behind bars.

Popcorn Lung Roadhouse Blues 2008
Occupational exposure to the vapors from artificial butter flavor can cause bronchiolitis obliterans, a debilitating and sometimes fatal lung disease. Dozens of workers at microwave popcorn factories or factories where these flavors are produced have become sick, and at least one worker has died. Others are awaiting lung transplants. Thousands more workers are exposed at factories that make or use flavorings throughout the country. This is a case study in failings of our public health protection system. For more than five years, government scientists have conducted studies that have identified ways to protect workers and prevent this illness. In the face of mounting scientific evidence of a serious hazard, and recommendations on ways to prevent the disease, the Occupational Safety and Health Administration (OSHA) has done virtually nothing. Diacetyl is a commonly used food flavoring and is the primary constituent of artificial butter flavoring. There is compelling scientific evidence linking occupational exposure to diacetyl to bronchiolitis obliterans, a debilitating and sometimes fatal lung disease. In the general population, bronchiolitis obliterans is rare. In the last few years, however, numerous cases have been reported to or identified by the National Institute for Occupational Safety and Health (NIOSH) among workers employed in factories where flavorings containing diacetyl are produced or used. Dozens of workers employed at microwave popcorn packaging plants have developed occupational lung disease and at least one has died. Several of these workers are on lung transplant lists.
